Implementation Strategy

 

Effective Implementation

The effective implementation of the LPP and LIP requires

  • A comprehensive information and publicity campaign
  • Capacity building for the labour administration system and the social partners, relating specifically to labour policy and labour protection
  • The revitalization of existing institutions and the establishment of others
  • Commitment from employers, workers, and their organizations and the labour administrators to the changes envisaged in the policy documents
  • The reform of operational arrangements within the labour administration system
  • The revision, consolidation, application and enforcement of labour laws

Specific Activities
The implementation of each of the above elements involves various activities as follows:

Information and Publicity

  • Translating policy documents
  • Preparing policy summaries
  • Designing policy cover pages
  • Printing policy documents and summaries
  • Disseminating policy documents and summaries
  • Preparing press releases
  • Arranging nation wide media coverage, both print and electronic
  • Posting information on websites
  • Producing CD-ROM materials
  • Planning and conducting national policy launch
  • Planning and conducting provincial briefings

Capacity Building

  • Assessing the existing capacity of the labour administration system
  • Assessing the existing capacity of employer and worker organizations
  • Assessing the existing capacity of education and training institutions to provide training in the fields of labour protection and labour inspection
  • Identifying capacity gaps
  • Preparing performance improvement plans
  • Preparing training plans
  • Preparing training materials
  • Planning and conducting training activities

Institutional Revitalization and Development

  • Convening the National Tripartite Labour Conference
  • Creating the National Labour Inspectorate
  • Reforming the minimum wage determination system
  • Establishing the National OSH Council
  • Establishing the Provincial OSH Institutes

Building Commitment to Change

  • Identifying issues of concern to employer and workers
  • Involving employers and workers in discussions on the minimum wage system
  • Involving employers and workers in discussions on the relation between working conditions and productivity improvement
  • Involving employers and workers in discussions on the relation between living conditions and productivity improvement
  • Involving employers and workers in discussions on unemployment benefits/insurance
  • Informing employers, workers and labour administrators on progress concerning policy implementation
  • Conducting training activities for employers, workers and labour administrators, individually and collectively

Operational Arrangements

  • Extending protection to the informal economy
  • Operating an integrated inspection system on a pilot basis
  • Establishing a registration and classification system on a pilot basis
  • Operating a self reporting inspection system on a pilot basis

Law Revision

  • Identifying changes in the law to meet policy requirements
  • Consulting with social partners on proposed changes
  • Redrafting labour laws
  • Endorsing new laws
  • Drafting supporting regulations
  • Informing stakeholders of new laws and regulations
  • Applying and enforcing new laws

Management and Monitoring of Policy Implementation

Effective implementation, particularly in the initial stages, requires that a management and monitoring system is in place to oversee and coordinate all implementation activities. This requires the following:

  • The appointment of a Policy Implementation Coordinator based in the Ministry of Labour (funded under the ADB TA, on a short term contract basis)
  • Preparing an implementation schedule (see below)
  • The formation of a Policy Implementation Advisory Group to guide the implementation process, such group to be comprised of:
      • The CLA or nominee
      • Provincial Directors of Labour (4)
      • DG Workers’ Education Department, MOL
      • Chief Inspector of Mines
      • Employer representatives (2)
      • Worker representatives (2)
      • National consultant under the ADB TA
      • International consultant under ADB TA, if required
  • Monitoring implementation and preparing and disseminating monthly progress reports
  • Publicizing the implementation activities
  • Evaluating successes and achievements, shortcomings and failures
  • Deciding on future action once initial implementation phase is complete
